Indian women [urban] are worse than western women. They misuse the pro-women laws in India and take the advantage of modern and traditional values together. They kick tradition in the day and sleep with it at night.

Alimony in divorces is a serious issue these days. Huge alimonies have stripped men of their finances in the West and this trend is slowly catching in India as well with the growing number of divorces. Recent studies in Mumbai showed that 40 % of marriages end in divorce. In Delhi, every day on an average 10 divorce cases are filed. And in majority of these cases men are ordered to pay alimony as they say alimony in divorce is a positive step towards “Women Empowerment” by making them financially independent. But alimony as a provision in divorce is despicable and subject to serious condemnation for many reasons underlined here,
Arranged Marriage in India is a communal decision and takes place as a result of the involvement of society elders, common friends and the parents of both the boy and the girl. Hence when the relation fails to work and ends in a divorce, the husband should not be the only one paying.
If it is a love marriage then both the adults are equally responsible and the man should not be the only one paying the price.
Alimony is the biggest motivator for women to file a divorce and stop making attempts to save the marriage. Also parents of girls, when they see the marriage is not working, encourage their daughters to move towards divorce in lieu of hefty alimony.
Due to the overwhelming and impending burden of alimony, married men in India continue to suffer in a bad marriage and refrain from buying a costly piece of paper called, ‘Divorce’ which results in higher stress levels for men and also higher suicide rates among Indian married men.
In line with the feminism that created waves in the 70s in the West, harsh, lopsided and severely anti – male laws were drafted in India in the name of Women Protection. And at the same time alimony was encouraged in the name of Women Empowerment. Today we have six laws quintessentially achieving the same objective of Women Protection and Women Empowerment in tandem.
But the basic ideology where the law makers, the society living with those laws and the media sleeping in deep slumber, not to protest against the loopholes in the laws and their implementation, fluttered is that, Protection and Empowerment can never go hand in hand. We don’t need to protect an empowered lot, hence when alimony was already provided for Women Empowerment, Women Protection was a redundancy. And if that was not the case then alimony as a means to Empower Women has failed miserably and has rather proved as a “Marriage Breaker” as reflected in a recent statement by renowned Supreme Court justice Arijit Pasayath that the Hindu Marriage Act has broken more families than joining them.
The statements seem more than apt. Though Hindu Marriage Act has provisions for saving as well breaking marriage, the one breaking marriage is more famous i.e. divorce. The section for saving marriage, Section 9 – Restitution of Conjugal Rights is a dead letter section of the Hindu Marriage Act which quintessentially trivializes the Indian culture of saving marriage, but sadly enough it is not only a lesser known section, it is non – executable as well, which means the court cannot enforce an order passed in this section.
Due to such reasons divorces are increasing day by day and the institution of marriage is slowly dying out. The government which barely manages to gather oxygen enough to survive in wake of recent turmoil and power tussle at the center has little / no time to look into this matter, impending over the society as a social catastrophe. The society, whose very existence is subject to strict proof with everyone in the society considering everyone else other than oneself as the society, with its paradoxical veil of technological advancement conveniently, chooses to ignore the victims of a bad marriage. The media, whose hunger for sensationalism is self – feeding, considers only the women as humans, raising its voice for women at every sneeze and whiff, is simply catalyzing a gender divide in the society and nothing else.
In view of the all the above contentions and discussions, yet it remains a question, whether Empowerment and Protection can go hand in hand? Let the stalwarts answer this.
The Facade called Women Empowerment:-
Women Empowerment, Women Equality, etc. seem to be the buzzwords these days with more and more articles coming about increased awareness amongst women about their rights. Since so many decades we have been hearing of these campaigns and they are still running. Feminists still seem to cry about women rights and women empowerment and women equality. For the past almost three decades women empowerment is happening and crores of rupees are spent on it every year and yet if the need for the same is felt, then either something is wrong with the women or the empowerment.
Whatever be the cause, in all this efforts by the various lobbies and groups, the real cost of Women Empowerment is being borne by men for whenever they try to talk about their problems / rights / issues, they are subdued saying Women Empowerment is more important and their problems always take a back seat when it comes to implementing solutions. And that is the reason in the past 60 years, not a single rupee has been spent for men’s welfare.
One of the most active areas where women equality echoes is the institution of marriage in India. Marriage in India has always been projected as a “necessary evil” for women and in this process it is the men who are made to pay the price and are told to adjust / compromise at all times asking them to do so in the name of Women Equality. So what exactly is this equality, let’s look at it with a few examples,
If a wife wants to open joint account with husband’s salary account – then it is her right and she is preventing misuse. On the other hand, if husband wants to open a joint account with his wife’s salary account, he is interested in her money. And he needs to be sent to jail for Dowry harassment.
If wife asks his husband to stay away from his parents, then she does not want any interference from in-laws. When husband asks for the same from his wife to keep little distance from her parents he will be thrown out from the House as per the Domestic Violence Act.
If wife ridicules the husband for job then she is encouraging the husband to look for high paying job. When husband asks his wife to look for respectable job – this will be termed as mental cruelty and along with husband all his relatives including parents, siblings will be sent behind bars under IPC 498A.
If wife demands a car from husband then she is improving the standard of living. If husband says that they should have a car, then he along with his mother and sister will be sent behind the bars and will not be freed till the time he does not prove beyond reasonable doubt that he had not demanded.
If wife demands a flat in her name then she is creating security for the family. If husband says that their family should have a flat on joint name then again he is demanding dowry as flat from wife and in-laws to keep his parents and will be booked as offence punishable along with his mother and sister under 498A and the Domestic Violence Act.
If wife goes to media / her husband’s office to complain against husband and in-laws she is asking for justice. If the husband defends his point by replying to the allegations of wife then he is defaming the wife and in-laws and as per the Domestic Violence Act he should be thrown out of his own house.
When a couple gets gifts during the marriage from boy’s side then it is considered as stridhan and wife has full right on them, whereas if the husband is given some gift from in-laws then it is dowry and he does not have any right over it.
If wife asks the husband to cook meals then she wants husband to share household chores, whereas if the husband asks his wife to cook meal or help him in getting food articles from market then he is confronted with an argument that he should have married a cook not a lady wife.
If wife demands more conjugal relations with husband then it is her right. If husband wants the same from wife then he is committing marital rape which is an offense punishable with strict imprisonment.
If wife stays away from husband due to any dispute or her own wish then she is said to be protecting herself from cruelties of husband and in-laws. If husband stays away from wife to avoid further confrontation and let things cool down then he has deserted his wife and along with him all his family members are sent behind bars without any investigation under Section 498A of the IPC.
If wife wants to divorce and husband doesn’t want so it is normally granted happily by court. If husband wants divorce and wife doesn’t want then it is never given by court.
A wife can file innumerable complaints against husband, in-laws, and other relatives of husband in Crime against Women Cell including mother-in-law, married / unmarried sister-in laws, kids from in-laws family. Husband cannot file complaints against wife, her parents or relations. There is no Crime against Men Cell. He does not deserve it, he is supposed to be treated like this only tolerating abuse both from the wife and in-laws and abuse in the form of misuse of laws targeted against him.
Wife keeps the custody of minor child as she is considered to be the natural guardian / friend of the child. If husband wants to keep the custody of the child then he is said to be depriving the mother and child of each other’s affections.
If wife wants to manage the accounts and balances of money then she is a better manager and is concerned about the family. If husband wants to do the same job then he is a spend thrift with no concern about the family.
If wife has extra-marital affair then the husband has deprived her of love, affection and other happiness in life, and she will be rewarded for Bigamy as per New Domestic Violence Act. If husband has extra-marital affair he is a womanizer and is guilty of bigamy, and will be thrown out of house and all his bank account will be attached.
If wife take some items from home then it is her right. If husband take few items from home then it is a theft and wife does not hesitate to file a case and the system allows the same as well whereas if a husband tries to file a case he is made to run from pillar to post discouraging him to do so.
If wife plays with the child and takes the child to her parents place then she is concerned about child’s growth and providing with balanced family life. If husband plays with the child and want to take the child at times to his parents place he is accused of snatching the child from the wife and her parents and is charged with kidnapping.
If wife’s parents come and stay with the couple then it is their right. They have given their daughter. If parents of husband come to visit and stay with the couple then they have come to interfere in couple’s life and ask for dowry.
These instances are just illustrative and not exhaustive of the clear and visible existing bias against men which is carried out under the name of Women Empowerment and the women are enjoying it and so they actually never want to achieve true equality. For they know, the day it is achieved, then the Women Pamperment that is happening will stop. For women, women empowerment is a path where the journey itself is more intriguing and fruitful than the actual result and the stakeholders of the system also benefit a lot from this and thus want to carry it on, albeit at the cost of men.
The system and the society are not ready to make absolutely any efforts to stop it or give men their due rights. For they know it is easy to instigate women to take such steps and break their marriages. The more the marriages break, the more consumerism increases as more households are formed. Moreover people, especially women, tend to spend more to overcome a relationship stress. Increased consumerism directly helps the capitalists as their invested money rotates in the market and they gain, albeit at the cost of the society and age old values, morals and the family structure and the institution of marriage. The same money is used to fund various women empowerment schemes and promote anti – male laws and thus it forms a vicious circle which keeps sucking blood from the society and the sleep walking society is breastfeeding the monster by not objecting to the ongoing injustice.
Marriage is a crime for men in India:-
Marriage – the most controversial social institution – has always been at the center-stage of debates. However, of late, since the last decade, a new trend of criminalizing marital disputes has begun. This trend has started victimizing the “Indian Husband” and his family in a big way and has resulted in,
Skyrocketing expectations from men and nose-diving acceptance levels.
Ever-increasing suicides by husbands – 6 times the rate they are born.
Family-breaking.
Child and elder abuse.
Erosion of faith over the institution of marriage leading to promulgation of homosexual relationships, pre-marital sex, sexually transmitted diseases, etc.
Increased juvenile crime.
Drug abuse.
Teenage pregnancies (the trend is catching up and no sooner would be a social reality in India).
Resentment amongst affected, victimized and unheard men and their families towards the police, judiciary, the law and order system, the criminal justice system and the Govt. at large.
Splurging divorce rates.
All in all, it has created newer, unforeseen and unanticipated problems in the society. However, religious conservatives and social contractors are still not opening their eyes to the problem. Thanks to their stubborn behavior they are compromising human lives and human happiness in their over-zealous efforts to “save” the institution of marriage.
However, quintessentially, all they do is to pressurize the man in the marriage to accept unreasonable demands from the woman and/or the society. For e.g. the recent drama that unfolded in Shoaib Malik’s case. Till the time news of marriage of Shoaib-Sania were not reported no one (including Ayesha and her family) were really bothered about the alleged marriage of Shoaib and Ayesha. But as soon as the news came up, suddenly everyone was interested.
Merely because Shoaib signed on the divorce papers does not validate the marriage because Shoaib had been subjected to “Extortion Patronized by State (EPS)” and was forced to sign the divorce papers. Marriage had been forced unto Shoaib.
A false case under sections 498A, 420 and 506 was lodged against Shoaib and he was publically exhumed by the media. The Imam of Kolkata threatened to issue “Fatwa” against Shoaib if he did not accede to Ayesha’s demands. The police grilled Shoaib for 2 hours and retained his passport as well.
Now my question here is, “Who is Ayesha Siddiqui?” Has anyone bothered to know that? She is just a woman claiming to have married Shoaib some 8 years back! So where was she for 8 years?
No one – the police, the judiciary, the media, the society, the religious conservatives, the social contractors – is really bothered to ask these questions to Ayesha. Why? Merely because she is a woman and Shoaib is a man? So the net result is – when a woman complains against a man in the nature of a marital relationship, the woman is ALWAYS RIGHT, no matter how illogical, after-thought the complaint is and how extortionary are her demands?
When out-rightly Ayesha and her family were denying involvement of any money in the settlement, than why media reports of “150 million of settlement” made rounds? And why now, after allegedly receiving the amount, Ayesha no longer wants to pursue the case?
Is it not a clear case of “Extortion Patronized by State (EPS)?”
The reason I am posing these questions here is because no one else did.
But everyone was either a party or a silent witness to Shoaib’s turmoil of going through a 498A case. It was only SIFF that supported Shoaib which was an unexpected welcome move even by Pakistan.
A woman makes an unsupported claim (of marriage) against a man, does not even come out in open and based on that complaint, the civil liberties of a man is violated, his reputation is strangulated in broad daylight, he is extorted and made to cough out a fortune and no questions are raised against the irrational and unreasonable behavior of the woman, no support is extended to the man and any such support is marked off as “unexpected”!!!
Merely because the allegations pertain to a marital dispute, anything and everything under the sun – starting from violation of civil liberties to broad daylight murder of social reputation to state sponsored extortion (EPS) – goes unchallenged?
Is marriage a crime for men in India?
Because Shoaib was a celebrity, he still faced very little harassment and even his harassment got widespread publicity. Had it been some common man, he would have been thrown behind the bars and no one would have bothered about him and his family even.
As per National Crime Records Bureau in the year 2008 alone, 37369 women and 127492 men lost their civil liberties as they were arrested under Section 498A without trial or investigation. Taking into account 5 years from 2004 – 2008, a total of 160416 women and 550804 men have undergone a similar ordeal.
All this goes on because not only marriage is a crime for Indian men; the Indian Govt. is not taking any steps to contain the abuse of humanity perpetrated by the notorious Section 498A. Indian Govt. is directly responsible for such inhuman treatment of men in India. The Supreme Court of India had warned against Section 498A terming it as “Legal Terrorism” way back on the 20th of July 2005. Close to five years have passed and the Indian Govt. is sleeping over it.
With the Shoaib Malik episode the “Extortion Patronized by State (EPS)” came out in open completely.
While the dispute between Malik and Siddiqui was completely civil, a wrong law and wronger implementation of the law allowed the Siddiquis to extort the Maliks and a civil dispute was criminalized endangering the civil liberties of an otherwise law abiding citizen. Such criminalization of civil disputes is a very dangerous trend. If the Indian Govt. does not react to this scenario and take a corrective step by scrapping Section 498A, then it will be directly responsible for the civil liberties of citizens being violated, their fundamental right to fair justice being impeached and lives and years of life of innocent people being tanned in this furnace of social injustice.
It is now very clear that the very concept of marriage is crime in India and any woman can extort any man in the name of marriage – whether they met, got married, cohabited together, led a family life et. al. are all pointless debates. What matters is that there is a complaint from a woman against a man and that is basis enough for all kinds of injustices on the accused man – social, legal, financial, emotional, humanitarian – and this is what I object to vehemently.
Even the society does not seem to have any problem with such high dose of inhumanity being practiced widespread. When I started a discussion about this on the Facebook, I got some replies like, “498A is much justified on Shoaib because he ditched Ayesha to marry another woman”.
So there is a pre-judged notion in the society that merely because Ayesha is complaining, Shoaib must have ditched her and that pre-judged notion becomes the basis of all injustices henceforth. If Ayesha was so truthful, why she did not pursue the case? Why accept money? Why not come out in open? But no one will ask these questions as somewhere silently everyone wants criminalization of marriage because it fits the “Male-Disposability Syndrome”.
However, the fact remains – Marriage is a crime for men in India.
Either stop criminalizing marriages or stop marriages!
I’d be really interested to know why being “a human being” should be seen as being better than being “a human doing”. I personally would rather be valued for my actions than my gender.
